Welcome to Backman Heating & Cooling. These Terms and Conditions (“Terms”) govern your use of our website (https://backmanheating.ca) and the purchase and delivery of our HVAC services, including installation, repair, and maintenance.

By accessing our website or booking a service, you agree to be bound by these Terms. If you do not agree, please refrain from using our services or website.

1. Scope of Services

Backman Heating & Cooling provides professional HVAC services for residential and commercial properties in Canada. These services include, but are not limited to:

  • Installation and repair of furnaces and air conditioners.
  • Heat pump and water heater servicing.
  • Emergency repairs and preventative maintenance.

All services are subject to technician availability and a physical site inspection.

2. Estimates and Pricing

  • Quotes: Any quote provided online or over the phone is a preliminary estimate based on the information provided by the customer. A final, binding price will only be confirmed after an on-site assessment.
  • Validity: Estimates are valid for 30 days from the date of issue unless otherwise stated.
  • Taxes: All prices are subject to applicable federal and provincial taxes (GST/HST) unless expressly included.

3. Appointments and Cancellations

  • Access to Property: You agree to provide our technicians with safe and clear access to the equipment and work area. This includes ensuring pets are secured and the workspace is free of obstructions.
  • Cancellations: We require at least 24 hours’ notice to cancel or reschedule a service call. Cancellations made with less than 24 hours’ notice may be subject to a “Short Notice” fee.
  • Arrival Windows: While we strive for punctuality, arrival times are estimates. We are not liable for delays caused by traffic, weather, or unforeseen complications at previous job sites.

4. Payment Terms

  • Due Date: Payment is due in full upon completion of the service unless prior financing or billing arrangements have been made in writing.
  • Methods: We accept Credit Cards, E-Transfers, and Cheques.
  • Late Payments: Overdue accounts may incur interest at 2% per month (24% per annum) on the outstanding balance.

5. Warranties and Guarantees

  • Workmanship: We provide a [e.g., 1-year] warranty on the labour and workmanship performed by our technicians.
  • Manufacturer Warranty: Equipment (furnaces, AC units, etc.) is covered by the manufacturer’s specific warranty. Backman Heating & Cooling is not responsible for manufacturer defects, but will assist in processing warranty claims where applicable.
  • Exclusions: Warranties are void if the equipment is tampered with by an unauthorized third party or if damage is caused by owner negligence (e.g., failure to change filters).

6. Limitation of Liability

To the maximum extent permitted by Canadian law, Backman Heating & Cooling shall not be liable for:

  • Indirect, incidental, or consequential damages (including loss of profits).
  • Damage to property resulting from pre-existing conditions, such as fragile or non-code-compliant ductwork or electrical systems.
  • Delays caused by “Force Majeure” events (e.g., extreme weather, supply chain disruptions, or government mandates).

7. Customer Responsibilities

The customer is responsible for:

  • Obtaining any necessary permits or condo board approvals required for the work.
  • Ensuring the HVAC system is accessible and the surrounding area is safe for work.
  • Verifying that all provided contact and billing information is accurate.

8. Intellectual Property

All content on Back Man Heating, including text, logos, images, and service descriptions, is the property of Backman Heating & Cooling and is protected by Canadian copyright laws. You may not use our content for commercial purposes without express written consent.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario/Nova Scotia and the federal laws of Canada. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.

10. Modifications to Terms

We reserve the right to update these Terms at any time to reflect changes in our business practices or legal requirements. The “Last Updated” date at the top of this page will indicate when the latest changes were made.
